Florida has a homestead protection meaning that your home is protected if you file for bankruptcy. Now, that does not mean that you can stop making mortgage payments. You have to continue making your mortgage payments, but as far as your creditors go, and as far as the bankruptcy trustee liquidating your home, that does not happen. There are requirements such as residency and the amount of time that you have owned the home prior to filing bankruptcy that would be involved. Generally speaking no, the homestead is not going to be taken in the bankruptcy.
