A 341 hearing happens in every bankruptcy that is filed. It normally takes place 30-45 days after filing and that is where the debtor with meet with the trustee. The attorney, the debtor’s attorney, is present also, sitting right next to the debtor. In the case of a Chapter 13 hearing, the trustee generally asks what type of work the debtor is involved in doing? What type of income the debtor has? And make sure the debtor understands the payments that are going to be made under the payment plan.
With relation to a Chapter 7, that trustee is asking more about assets, because Chapter 7 involves the liquidation of assets whereas Chapter 13 does not. In the case of both hearings or meetings, they generally only take about 5-10 minutes. They’re very short in duration.
